The purpose of these general terms and conditions of use (hereinafter referred to as the "GTCU") is to determine the rights and obligations of the parties in relation to the use of the Portal and the mobile application "MyFreedelity" (hereinafter jointly referred to as the "Application") published by the company Freedelity S.A. By installing the Application on your terminal and/or by accessing the Application, as a visitor and/or user, you acknowledge and accept unconditionally and without reservation all of the GTCU defined below. If you do not wish to accept this or if you have any questions please do not access the Application and contact us.
Any visit and/or use of the Application must be made in compliance with this contract
The purpose of the Application is to allow You to access and manage Your personal data, both in terms of content and use, including the management of the consents given to Freedelity's Clients. This tool enables you to enjoy the benefits provided by Clients.

To access and use the Application, You must have a device with access to the Internet and/or a smartphone that is compatible with the use of the mobile application.
The Application can be downloaded free of charge from the: ‘Apple Store’ and ‘Google Play Store’ on most smartphones.
Freedelity has provided geolocation functions via the GPS of your mobile phone or by using your IP address.

This feature can be disabled or (re)enabled at any time and at no extra charge.
Freedelity and the User undertake to comply with the GTCU.
Freedelity will do whatever it can to make the Application available, secure its access and enable its consultation and use. The Application is accessible 24 hours a day, 7 days a week, except in the event of force majeure or an occurrence beyond Freedelity's control and subject to any breakdowns and maintenance operations necessary for the proper functioning of the Application. Maintenance work may be carried out without prior notice to Users.
The Application is provided to Users who have consented to the use of their personal data within the framework of their registration in the Freedelity file, in accordance with the terms described in the chapter ‘legal basis for the processing of your personal data’ described in the Privacy Policy available on the Portal and the Application: https://www.myfreedelity.com/privacy
Users have read and expressly accepted these GTCU, which determine their rights and obligations, in particular with regard to the use of their personal data, which is processed for the purposes of this contract and described in the Privacy Policy.
Customers are responsible for the subscription and access fees for their own IT networks.
The User has the right to change their personal settings. They may at any time exercise the rights provided for in the GDPR and thus, for example, delete the data collected by a Client.
The deletion by the User of certain data or the deletion of consents with respect to a Client implies that it is no longer possible to use the services made available by Freedelity and any benefits granted by the Client(s) in question.
The User hereby authorizes Freedelity to use certain personal data for the purposes necessary for the Application. Likewise, the User authorizes Freedelity to interact with the issuers of loyalty cards, which the User has stored via the Application, in order to optimize the means of communication between the User and the brand and to allow direct marketing (subject to prior consent).
Freedelity has the right to delete your MyFreedelity profile at any time, without notice and without compensation, in case of abusive, prohibited and/or fraudulent use (or suspicion thereof).
The GTCU are applicable to any User of the Application and Services offered. The applicable GTCU are those in force at the date of use of the Application. Use of the Application and its services implies acceptance of the GTCU to which You have access via a hypertext link to the Site.
Freedelity reserves the right to make changes to the GTCU, including by adding conditions to adapt them to changes in the services offered, technical and legal developments or jurisprudence, or when implementing new services. Freedelity will inform the User by simply putting it online. They are presumed to be accepted by any User who accesses the Application after they have been put online. In case of refusal, Freedelity reserves the right to deny the User access to its services

Any new Service incorporating new techniques or new characteristics that improve the quality of existing Services will also be subject to these GTCU, unless stated otherwise.

The Application may be updated on a regular basis. The application has a limited validity in time after being downloaded by a User, so it is important to take into account these updates, which must be downloaded, and possible technical, legislative or regulatory changes, which are beyond Freedelity's control.
Access to and Use of the Application confirms, insofar as necessary, the express acceptance of the provisions set out in the Privacy Policy available at any time: https://www.myfreedelity.com/privacy.This document contains crucial information concerning the use of your personal data and the protections implemented in accordance with the GDPR.
You have agreed to these conditions when you registered with one or more of our Clients and Suppliers.
The connection and visit logs of the Client or a User will be considered as having evidential force between the Parties.
If any article of the Convention is held to be illegal, invalid or unenforceable, in whole or in part, under any applicable law or court decision, such article shall be deemed not to form part of the Convention, without affecting the legality, validity or enforceability of the remainder of the Convention.
Each Party shall use its best efforts to negotiate immediately and in good faith a valid replacement article that will, as far as possible, maintain the economic balance and intent of the Parties as reflected in the deleted article.
Freedelity is the exclusive owner of all the intellectual property rights relating to the Application and its Content, subject to any of the rights of companies that Freedelity owns or for which it operates a licence.
Without prejudice to the provisions of this article, none of the provisions of the GTCU may be interpreted as a sale, transfer, concession, licence, loan, rental or operating authorisation given or made either directly or indirectly by Freedelity to the User for the Application, its Content and/or the Services.
The User declares that they will not take any action likely to infringe on the trademarks and other distinctive signs belonging to Freedelity, its Clients and other brands issuing dematerialised loyalty cards.
Freedelity grants the User a personal, non-exclusive, revocable, non-transferable, non-assignable, worldwide and free of charge right to use the Application, the Content and the Services solely for its own needs in the context of the use of the Application and the Services, to the exclusion of any other purpose.
It is strictly forbidden for the User to access and/or use the source codes of the Application and/or the software components of the Application. The User does not acquire any intellectual property rights vis-à-vis the Application, the Content and/or the Services or any other rights other than those conferred herein.
This licence does not confer any right of use to the User with regard to the Content.
The User is therefore prohibited from reproducing, representing, adapting and/or exploiting any of the Content and from infringing Freedelity's rights.
The personal data collected with your consent and accessible via the MyFreedelity mobile application is processed for the purposes described in the Freedelity Privacy Policy https://www.myfreedelity.com/privacy.You may, at any time, exercise your fundamental rights regarding the protection of your personal data.
Access to and use of the application and the Site implies unconditional acceptance of the Privacy Protection Policy that you have read and accepted when you registered and registered in the Freedelity file with one of our Partners.

Access to and use of the Application is at the User's own risk. The User takes responsibility for all the effects of configurations they have made, including deleting a Client and/or their Profile which, pursuant to the GDPR, results in the deletion of all the data relating to benefits in the Client’s dedicated file. In this case, the User is asked to contact the Client with whom they consider to have benefits.
The Application and software are provided "as is" and "as available" without warranty of any kind.
It is the User’s responsibility to take all the appropriate measures to protect their own data and/or software stored on their own computer and telephone equipment against any harm.
The User declares that they are aware of and accept the characteristics and limits of an Internet network, including its availability, congestion, access, risks of contamination by virus or hacking, saturation, etc.
Freedelity declines any liability:
Freedelity cannot be held liable under any circumstances for any damage, of any nature whatsoever, caused to Users, their devices, their computer and telephone equipment or the data stored on it, or for the consequences on their personal, professional or commercial activity.
Freedelity may terminate the use of the Application and the Portal at any time by giving You 20 days' notice of termination. At the time of termination, the rights and licences that were granted to You will be terminated and You must stop all use of the Application and Portal. The User may also terminate the Use of the Application and the Portal at any time, subject to 20 days' notice.
These GTCU are exclusively subject to Belgian law. Any dispute or controversy relating to the execution or interpretation of these regulations that cannot be settled amicably between the parties shall be submitted to the competent courts of the district of Walloon Brabant.

To be valid, any complaints relating to the Services provided must be brought to Freedelity’s knowledge, preferably by email, within 14 days of the time you became aware, or at least were informed of them arising.
If your complaint concerns a Freedelity Client, please communicate directly with the Client who will take sole responsibility for the commitments made to benefit its customers.
